1. Introduction

These Terms of Use (the “Terms”) govern your access to and use of the application and its features (the “App”), provided by Cybx.xyz (“we”, “us”, or “our”). By accessing or using the App you agree to these Terms. If you do not agree, do not use the App.

2. Use at Your Own Risk

You acknowledge and agree that use of the App is entirely at your own risk. The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

3. Exclusion of Liability

To the fullest extent permitted by law, Cybx.xyz and its developers are not liable for any loss, damage, injury, claim, cost, or expense, whether direct, indirect, incidental, special, or consequential, arising from or connected with your use of, or inability to use, the App.

This includes, without limitation, any loss or damage caused by malware, errors, omissions, interruptions, deletion of files, defects, delays, or performance issues.

4. Liability Cap

Where liability cannot be excluded, our total aggregate liability to you (whether in contract, tort including negligence, or otherwise) is limited to the greater of:

• £1 (one pound sterling); or
• the total amount you have paid (if any) for use of the App in the twelve (12) months preceding the event giving rise to the claim.

5. Exclusion of Consequential Losses

We are not liable for any of the following, even if foreseeable:

• loss of profits, sales, business, or revenue;
• loss of data, goodwill, or reputation;
• business interruption;
• loss of anticipated savings; or
• any indirect or consequential loss or damage.

6. Force Majeure

We are not responsible for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, war, terrorism, strikes or other industrial disputes, failures of utilities or telecommunications, or changes in law or government action.

7. Your Responsibilities

• Keep your device and data secure while using the App.
• Ensure any content you submit, share, or store is lawful and does not infringe the rights of others.
• Comply with all applicable laws.
• Do not use the App for unlawful, harmful, or prohibited purposes.

8. No Warranty

• We do not guarantee that the App will be error free or uninterrupted.
• We do not guarantee that any content or data will be accurate, complete, or current.
• We do not guarantee that security measures will prevent all unauthorised access or breaches.

To the extent permitted by law, all warranties, conditions, and terms implied by statute, common law, or otherwise are excluded.

9. Indemnity

You agree to indemnify and hold harmless Cybx.xyz, its developers, employees, contractors, and affiliates from and against any claims, demands, losses, damages, or expenses (including reasonable legal fees) arising from your use of the App, your breach of these Terms, or your infringement of third-party rights.

10. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted in the App or on our website. Your continued use after changes are posted means you accept the updated Terms.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms or their subject matter or formation.

12. Severability

If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision shall be severed to the extent required, and the remaining provisions will continue in full force and effect.
